GENERAL LIABILITY

I acknowledge that many of the activities of the Live Out Loud Performing Arts involve physical skills of the participant that may cause injury.  I am aware of the usual risks and dangers inherent in participation in all of the activities associated with the outdoor program which may include equine activities and the possibility of personal injury and or death, property damage or loss resulting from the activities. The dangers may include but are not limited to rugged terrain, tree fall, weather, the possibility that the participant may not heed safety instructions or restrictions given to the group, delayed rescue, accessibility, conduct of the guide, chaperones or other group members.

I certify that the participant is fully capable of participating in the activities.  I state that I have read the above statement on some of the possible risks in these activities. Therefore, I assume full responsibility for the participant, for bodily injury, death and loss of personal property and any expenses as a result of the negligence of the participant. I fully understand that Live Out Loud Performing Arts reserves the right to refuse any person it judges to be incapable of meeting the rigors and requirements of participating in the activities. I certify that the participant is in good physical condition and able to undertake this activity.

I agree to indemnify and hold harmless Live Out Loud Performing Arts, their agents and employees from any and all claims, damages, losses, injuries and expenses arising out of or resulting from participating in these activities.  I further agree to release, acquit and covenant not to sue Live Out Loud Performing Arts, their agents and employees for any and all actions of Live Out Loud Performing Arts.

I agree to waive any and all claims I may have against Live Out Loud Performing Arts, and release from all liability and agree not to sue Live Out Loud Performing Arts and it’s officers, employees, agents, volunteers and representatives, for any personally injury, death, property damage or loss sustained as a result of participation in the outdoor activity.

If the participant experiences an injury or illness, or has other medical needs, I authorize the Live Out Loud Performing Arts’ employees, agents and/or volunteers to make such arrangements for participant health and safety, including but not limited to first aid, emergency medical care, ambulance or other transportation to a hospital, medical office, or clinic, testing and examination, and hospital care, and other medical care and treatment (including dental care) as they feel is appropriate in the circumstances. I further agree that I am fully responsible to pay all charges and expenses relating to such care, transportation and treatment and I hereby fully release Live Out Loud Performing Arts it’s employees, agents and volunteers from any claims, including claims for medical charges, prescription costs and other expense, I might have as a result of such care, transportation and treatment. My electronic acknowledgement serves to indicate my willingness for my Health Insurance Company to be billed for any and all medical fees and services should they be needed. I agree that I will pay all charges and expenses not covered by insurance.

The participant fully understands that accidents can be the result of the nature of the activity and can occur with or without any fault on either the part of the participant or the Live Out Loud Performing Arts or its employees or agents, or the facility where the activity is taking place.  By allowing the participant to participate in this activity I am accepting the risk of an accident occurring, and agree that this activity, is suitable for the participant.

By electronically acknowledging that I consent to this waiver, I am not relying on any oral or written representation or statements made by Live Out Loud Performing Arts, its servants, agents, employees, or authorized volunteers to induce me to permit the participant to participate other than those set out in this consent and Waiver.

MEDIA RELEASE

Media Release Permission: 

Permission is hereby for the Live Out Loud Performing Arts to take and use photographs or videos of the participant for promotional/marketing purposes of Live Out Loud Performing Arts only.  Images will not be sold or loaned to any other organization. To person will be identified by name unless further permission is granted.

I am 19 years of age or more and have read and understand the terms of this consent and waiver, and understand that it is binding upon me, my heirs, executors and administrators.
